The essentials for the registration of co-operative societies in Kenya are stated under Section 5 of the Co-operative Societies Act, Chapter 490 Laws of Kenya.
For a society to be registered under the Co-operative Societies Act, it must:
- In the case of a primary society, consist of at least ten persons all of whom shall be qualified for membership of the co-operative society under section 14.
- In the case of a co-operative union has at least two registered societies as its members.
- In the case of an apex society, consist of at least two registered secondary societies.
